SUBJECT: Display of Confederate battle flags

 

1. Purpose. To provide information on the Army policy and commander's options in regard to display of Confederate battle flags.

 

2. Facts.

a. Army Regulation 600-20, para 4-12.c. gives commanders the authority to prohibit soldiers from participating in activities that the commander determines will adversely affect good order and discipline or morale within the command. This includes, but is not limited to, the authority to order the removal of symbols, flags, posters or other displays from barracks. This provision of the regulation in interpreted to also include all areas under the commander's control, such as the unit common areas or unit parking lots.

 

b. Commanders may restrict the display of Confederate battle flags, in whatever form, if they believe that the display of Confederate battle flags adversely affects or disrupts good order and discipline in their unit.

 

c. Confederate battle flags that are integrated, by law, into a state license plate, such as the Sons of Confederate Veterans license plate issued by the state of North Carolina, cannot be restricted.

 

d. Commanders who are unclear about the limits of their authority in a particular situation in ordering the removal of a flag, license plate, bumper sticker, item of clothing or other display should consult their Brigade Trail Counsel, or the Chief of Administrative Law at 2-0178.
