SLRC Was Filing Lawsuit
Against S.C. Democrats
Black Mountain, NC - The Southern Legal Resource Center was in the midst of drafting a federal lawsuit against the South Carolina Democratic Party at the request of the South Carolina American Civil Liberties Union when news arrived that the Party had dropped its "loyalty oath requirement"
The Board of Directors of the Southern Legal Resource Center, Inc commends the Democratic Party of South Carolina for eliminating the "Loyalty oath as voting requirement in the South Carolina Presidential Primary - to be held tomorrow.
"It was the right thing to do, and if we had sued - you would have lost," said Lexington attorney Lourie A. Salley, III Chairman of the Board of the SLRC about the SC Democrats. "The ACLU was ready to go, had a Plaintiff ready to go - we were going to file in the morning and ask for a temporary restraining order immediately before a US District Court Judge in Columbia," Salley added.
The Plaintiff, a Lexington businessman, ACLU member and practicing Quaker, objected to the oath on religious grounds.
"We were contacted by the ACLU at about 2PM Monday afternoon, but we started work at once and were prepared to work all; night if need be to file a Complaint and Temporary Restraining order tomorrow morning," said ACLU member and SLRC Chief Trial Counsel, Kirk D. Lyons. "When the Dems threw in the towel at about 4PM, we already had the Complaint ready, were working on the Plaintiff's affidavit and had outlined the memorandum of Law for the Temporary Restraining Order," Lyons added.
Although not necessarily a "Southern heritage" issue, the Board of Directors saw this issue as vindicating an important liberty issue - the right to vote - and was glad to help out another legal organization fighting for the civil rights of all Americans.
