SLRC UPDATE:
22 April 2003
SPLC Trashes SLRC (Again...)
Compatriots,
I'm mad!. The Southern Poverty Law Center trashes
the SLRC in its latest intelligence update for among other things, our
removal as counsel of record from the Texas Supreme Court Plaque case.
Members of the Texas Division helped to pull on the rope. We have done
all we could to be a good sport about our removal from the case and not
do anything that could jeopardize the Division's handling of the case.
But rumor compounded upon rumor seems to be spreading through Texas
Division about our removal from the Plaques case and that cannot go
without a response. Much of this poisoned gossip was spread to injure
our relationship with the Texas Division UDC.
Here is what Morris Dees had to say:
Texas SCV official Jerry Nelson wrote that
the council also rejected keeping Lyons on as co-counsel because “such
an appointment was not in the division's best interest.” Marshall
Davis, public information officer for the Texas SCV, clarified that
statement: “The best I can say is the division was not pleased with
his progress as we were proceeding on this case. I think the division
officers felt that it was not moving quickly enough for them.”
Questions?
- How many depositions has the new attorney taken
since the SLRC was removed from the case?
- Has Al Gonzales deposition been taken?
- Has Clay Johnson's deposition been taken?
- Has Chief Justice Tom Phillips deposition been
taken?
- It's been 7 months since the SLRC was removed.
Is the Division cutting a deal or going to trial? My sources seem to
indicate the former, not the latter.
I called the clerk's office this afternoon for the
53rd Judicial District Court. The only thing that has been filed since
the SLRC was removed is a Plaintiffs Motion to the insufficiency of the
Defendants responses to Plaintiff's request for Admissions (so a request
for admissions was filed) and a "supplement" to the 3rd Amended
Complaint filed by the SLRC!
Everywhere I marched in Texas, rank and file SCV
members told me how upset they were that the SLRC was removed from the
case and wanted to know: WHY? I did not know what to tell them.
Everything may be well in hand, but it is to you
the members of the Division to make sure that this lawsuit is proceeding
in the direction you want it to go.
Sincerely,
H.K. Edgerton
