SLRC Weekly Update

Greetings Compatriots:

It my pleasure to bring this week’s update to you.

DuPont Update - Sanctions Shot Down!

As all of you know by now, Kirk was in Richmond today for the hearing on sanctions in the DuPont case.  Words cannot explain the nervousness that Kirk D. Lyons faced today.  Before appearing at the hearing at 2:00, he filed a twenty (20) page rebuttal at the Old Confederate Treasury Building in the very room that was once President Jefferson Davis’ office.  Kirk thought this to be very ironic.

Everyone’s thoughts and prayers came through.  The judge lent a sympathetic ear and ruled against sanctions against Kirk.  This was an ABSOLUTE answer to prayer!

The judge then commented on the attorney’s fees proposed by DuPont’s counsel.  They documented 250 hours on this case.  The judge didn’t see how a "frivolous" case could warrant 250 hours work. The judge verbally praised Kirk and the plaintiffs for the "stick to it" attitude.  He acknowledged that the work the SLRC was doing was cutting edge and that along the way we should experience some losses.  Civil rights in the 60’s experienced many losses but look where it is today.  All the SLRC has to do is stay the course and keep knocking on the court’s doors.  Persistence is the key and we need everyone’s continued support so that Confederate Southern Americans will have equal rights.

Although sanctions were shot down, the plaintiffs will be responsible for some attorney’s fees.  We will not know the exact amount for another week.  This is still good news.  We jumped through the sanctions hoop and came out alive.  We appreciate everyone’s continued support!

The court has finally decided that oral arguments will take place on February 9th.  Kirk will have to travel to Philadelphia and argue the merits of this case in front of a three-judge panel.  We will keep you posted!
